WAIVER, RELEASE OF LIABILITY AND INDEMNITY AGREEMENT FOR

Men’s & Women’s Club College Sports – Swing Sports Management, LLC, c/o New England Premier League (NEPL)

Spring ’26 Season & Tournaments

READ PRIOR TO SIGNING- In consideration of being allowed to participate in any way for Swing Sports Management, LLC, its related events and activities, I acknowledge, appreciate and agree that:

1. Awareness and Assumption of Risks I am aware that playing or practicing any type of sport or athletic activity can be dangerous and involves many risks, which include, but are not limited to: death, serious neck, head, or spinal injuries that may result in complete or partial paralysis or brain damage; serious injury to all bones, joints, ligaments, muscles, tendons, and other aspects of the muscular-skeletal system; and serious injury or impairment to other aspects of my body, general health, and well-being, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation; and,
2. Participating Guidelines
   I willingly agree to comply with the state and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention to officials, staff and fellow participants immediately; and,
3. Health Responsibility I understand that the magnitude of the risks inherent in any sport or athletic activity depends, in part, upon my general health and physical condition or limitations. I recognize that I am solely responsible for assessing the effects of my health and physical condition on the risks inherent in my participation in such activities. I understand that Swing Sports Management, LLC, recommend that I consult my own physician prior to participation; and,
4. Risk Acceptance I have weighed the dangers inherent in participating in sports activities, the risks presented by my own health and physical condition, and my personal desire to participate in sports activities. I conclude that the risks inherent in my participation, both in general and as affected by my individual health and physical condition, are acceptable and outweighed by my desire to participate.
5. Student ID/Player Jurisdiction
   Participant understands that they must bring their student ID or digital photo version to every game to be eligible to play and failure to do so may result in ineligibility. Participant understands that Swing Sports Management, LLC reserves the right to suspend or ban any players who receive red cards for foul language, involvement in fights, and violent tackles/conduct. Referees are to be respected and treated appropriately; and,
6. Weather and Lightning Risks I acknowledge that participation in outdoor sports activities involves risks associated with weather conditions, including but not limited to severe weather, storms, and lightning. I understand that it is my responsibility to be aware of weather conditions and to follow any guidelines or instructions provided by event officials regarding participation during adverse weather. I acknowledge that within NEPL bylaws, if lightning is detected, all games are to be paused and suspended, and all players, personnel and spectators are to seek immediate shelter and wait a minimum of 30 minutes per strike before resuming any outdoor activity. I voluntarily assume all risks associated with weather and lightning, including the possibility of injury or death; and,
7. Medical Insurance Recommendation I understand that it is strongly recommended that all players have their own personal medical insurance. I acknowledge that Swing Sports Management, LLC does not provide medical insurance coverage for participants and that I am solely responsible for any medical expenses incurred because of my participation; and,
8. Medical Services Disclaimer I understand that while an EMS or athletic trainer on site is highly encouraged by the league, an EMS or an athletic trainer may or may not be present or in a rover position on campus, at field location before, during, or after any Swing Sports Management, LLC event. While any training service may be offered by on site staff, if such ambulance services are needed and called upon, I will be personally liable for covering all expenses for medical attention; and,
9. Equipment Responsibility I understand that it is necessary to be eligible to participate in Swing Sports Management, LLC events by wearing at least standard soccer shin guards and other appropriate soccer gear to help avoid injury. I recognize that I am solely responsible for the selection, maintenance, and use of any such equipment and my failure to do so may results in injury and bodily harm; and,
10. Infectious Disease Risks I understand that participation in any Swing Sports Management, LLC event includes possible exposure to and illness from infectious diseases, including, but not limited to common colds and illnesses, MRSA, all types of influenza, various strains of COVID-19, MMR, and all other diseases. While school rules and personal discipline may reduce risk, the risk of serious illness and death does exist. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of others, and assume full responsibility for my participation; and,
11. Venue and Jurisdiction
    This waiver and release of liability apply to any and all events organized by Swing Sports Management, LLC for NEPL and NEPL sponsored events throughout the United States. By signing this waiver, the undersigned agrees to waive their right to seek a lawsuit against Swing Sports Management, LLC, the New England Premier League, its representatives, officials, and furthermore any dispute arising out of or related to the activities covered by this waiver will be subject to the laws and jurisdiction of the state of Florida; and,
12. Consideration and Assumption of Risk
    In consideration of Swing Sports Management, LLC & the New England Premier League organizing tournament and league games for me to play between February 23, 2026, and May 4, 2026; including but not limited to NEPL regular season and postseason games, Boston Beanpot Tournament, Berkshire Invitational Tournament, IVY League Tournament, NESCAC Cup Tournament, any other tournament not listed, and/or friendly scrimmages, and to engage in all activities related to the events, I, on behalf of myself, my heirs, and assigns, personal representatives and next of kin
    • Voluntarily assume all risks associated with my participation and waive any right to make a claim or demand against Swing Sports Management, LLC, the New England Premier League, its officers, officials, agents and/or employees, referees, volunteers, administration, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity (“Releasees”).
    • Release Swing Sports Management, LLC, the New England Premier League, its representatives, officials, administration, volunteers and its referees from all liability, claims, causes of action, or demands of any kind or nature whatsoever that might arise by or in connection with my participation.
    • Agree to defend, indemnify, and hold harmless Swing Sports Management, LLC, the New England Premier League, its representatives, administration, other participants, sponsoring agencies, sponsors, advertisers, volunteers and its referees from and against all liability, claims, causes of action, or demands of any kind or nature whatsoever that might arise by or in connection with my participation.

By my written and/or electronic signature, I attest that I am of sound mind and body, I do so willingly, that I am at least 18 years of age as of February 23, 2026, and that I have carefully read the foregoing statement. I fully understand its contents, have had the opportunity to consult an attorney and/or ask questions regarding this document, and am aware that by signing this document, I may be giving up substantial legal rights to pursue a cause of action against certain parties, and it is my intent to do so. I sign this document of my own free will and volition, without any inducement, with full appreciation of the consequences of doing so. I further acknowledge under penalty of any legal course of action that I am signing this waiver solely on the behalf of myself and no one else.

Your waiver must be signed and returned to Swing Sports Management, LLC & NEPL officials before your first match to be eligible to participate.
